Renters Rights Act 2026 and Other Key Legislative Changes
The legal framework for landlords in England changed significantly from 1 May 2026. Private rented tenancies that fall within the new system now operate as assured periodic tenancies rather than the old assured shorthold tenancy model. New Section 21 no fault notices can no longer be used, so landlords who need possession must rely on the correct legal grounds and procedures.
From 1 May 2026, landlords and agents must also provide certain written tenancy information for new tenancies. In addition, most existing private tenants with written tenancy agreements must be given the government Renters Rights Act Information Sheet, with the deadline for doing so having been set at 31 May 2026. This is now an important part of compliant landlord administration.
Rent increases must now follow the formal statutory route. A landlord can normally increase the rent no more than once in any twelve month period and must use the correct written notice with the required notice period. Tenants also have stronger rights to challenge a proposed increase if they believe it is above the market rent.
The new rules also changed the position on rent in advance and pets. A landlord or agent cannot ask for or accept rent before the tenancy agreement is signed. Once signed, the amount of rent that can normally be requested in advance is limited. Tenants also have the right to ask in writing to keep a pet, and those requests must be considered properly and responded to in writing within the required timeframe unless more information is reasonably needed.
The Act also bans rental bidding above the advertised rent. Landlords and agents must advertise a clear asking rent and cannot invite or accept offers above that figure. This is an important change for how property is marketed and how offers are handled.
Further reforms are being phased in after the initial 1 May 2026 changes. These include the new private rented sector database and landlord redress arrangements, which the government has said will be introduced from late 2026 on a phased basis. Local authority enforcement powers have also been strengthened, with broader investigatory powers, expanded civil penalties and a stronger enforcement framework. For landlords, this means good records, accurate documents and careful compliance now matter more than ever.
Right to Rent, Deposits, Safety and Licensing
Right to Rent checks remain part of the legal framework in England and must be carried out correctly where the rules apply. Landlords and letting agents need to ensure those checks are completed before the tenancy starts and that records are kept in accordance with current guidance.
Deposit rules also remain important. Where a tenancy deposit is taken, it must be protected in a government approved scheme within the required time limits, and the correct prescribed information must be given. Strong inventories, good schedules of condition and organised records continue to be central to protecting a landlord’s position if there is a dispute at the end of a tenancy.
Landlords must also remain aware of their wider responsibilities for gas safety, electrical safety, smoke alarms, carbon monoxide alarms where required, licensing and general property standards. We help landlords keep these areas under review so avoidable problems do not arise through missing paperwork or weak systems.
Tax, Reporting and Making Tax Digital
Landlords are also facing wider reporting obligations beyond housing law. Making Tax Digital for Income Tax begins from 6 April 2026 for landlords and sole traders with qualifying income over £50,000. Lower thresholds are due to follow in later years. This means some landlords will need to use compatible software and move to more regular digital reporting to HMRC.
We do not hold ourselves out as tax advisers, but we do understand how important it is for landlords to prepare early, keep organised records and take proper professional advice where needed. For overseas landlords and clients with more complex arrangements, early planning and good administration are particularly important.
